INDERWEAR publishes the present Internet website dedicated to underwear, swimwear and other fashion accessories sales. The following terms and conditions are applied to all the sales made on INDERWEAR (the website).
By ordering on the website, you accept without reserve the Terms and Conditions, and respect all of the clauses. By accepting them, you are committed to the company INDERWEAR, SARL with a 30 000 euros fund and registered to the RCS of Bobigny under the number 522 474 998, and which is located to 104 Avenue de la Résistance, 93100 Montreuil.
Those Terms and Conditions can be modified any time, and without any prior notice.
The sales contract is composed of the Terms and Conditions applicable during the order and the purchase of order.
Your agreement concerning the Terms and Conditions does not require any hand-written signature from you, considering that you place an order on the Internet.
Unless otherwise stated, INDERWEAR online records are the evidence of your orders and payments.
Your order will be taken into account only after the payment confirmation from INDERWEAR.
The contract is subjected to the French law.
Prices are indicated in euros all taxes included, but excluding the packing and shipment costs. The customer can choose the prices to be shown in the currency of his choice. In that case, prices posted in the chosen currency are given on an indicative basis, according to the conversion rate of the day, and the customer will be debited in euros. The potential bank fees will be borne by the customer. Orders delivered outside the European Union are exempted from VAT on products and transports. Potential custom charges will be borne by the customer too. The prices indicated on the website can be modified any time. Invoiced prices are those applicable during the order. Promotional offers are valid during the periods mentioned on the website, subject to the order confirmation from INDERWEAR, and while stocks last.
In order to guarantee you the best quality of service and the best delivery time, the shipment is made by La Poste, GLS, Spring, Chronopost or TNT. The availability indicated on the website is indicative and does not guarantee the allowance of your order. The delivery time can vary in case of external events (wheather, traffic jams...).
Mainland France
The mainland France standard delivery is made within 4 days, subject to the confirmation of your order. This period includes working days only, excluding Saturdays, Sundays and public holidays.
The standard delivery is free in mainland France from 75€ of purchase. If your order does not reach 75€, you will be charged 5,90€ for a home delivery and 4,50 € for a pick-up point delivery.
Express delivery in mainland France (excluding Corse) is made the day after before 01:00pm, subject to the confirmation of your order before 10 :00. This period includes working days only, excluding Saturdays, Sundays, and public holidays. Express home delivery by TNT is charged 9,90€ in mainland France. It is free from 200€ of purchase. Chronopost express pick up point delivery is charged 7,50€ in mainland France. It is free from 200€ of purchase.
Overseas and International
We deliver the overseas territories, the European Union as well as many other countries worldwide. Please see the chart below to know the available countries, the shipment costs as well as the delivery schedule.
Orders delivered in overseas territories, and out of the European Union are exempted from VAT on products and transport. The potential custom fees at the entrance of the territory or the country will be borne by the customer.
United Kingdom: from January 1, 2021, all orders delivered to the United Kingdom are subject to UK duties and taxes. Depending on the delivery method, you will have to pay them with you order or upon delivery.
Norway: from January 1, 2024, all orders delivered to Norway are subject to Norwegian VAT.

Two options are available. Those services are optional and you will be charged for them in addition to the shipment costs.
Serenity Insurance
You can exchange freely your products during 60 days after the delivery. We will pay for the return of your products and the shipment of your exchange, without asking any explaination from you. This guarantee is applicable to all the items of your order (the items must be unworn and unwashed). This option is applicable only if you live in mainland France. It is charged 3€, all taxes included.
Gift box
Your order is gift-wrapped and goes with a personal message. This option is charged 5€, all taxes included.
All order is payable in euros. The payment is made online via a secure payment system such as Verifone e-commerce, Paypal and Stripe. The accepted means of payment are CB, Visa, Eurocard Mastercard, American Express, Paypal, Apple Pay, Google Pay, bank transfer, Bancontact and iDeal.
In the framework of the bank anti-fraud fight on the Internet, you may be asked to justify your identity, your place of residence and your means of payment. In this case, the treatment of your order will be made as from the reception of these documents. If we do not receive these documentary evidences or if they are non-compliant, the order may be cancelled and the account blocked.
Klarna offers payment in 3 instalments free of charge or deferred payment for orders of at least €50 to the following countries: Austria, Belgium, Finland, France, Germany, Greece, Ireland, Italy, Netherlands, Portugal, Spain. Payment must be made using a Visa, Mastercard or Maestro bank card.
3D Secure
In the framework of the bank anti-fraud fight on the Internet, you can be asked to authenticate your details when paying by credit card with the 3D Secure System. 3D Secure is an authentication payment system that reinforces the security of your purchase on Inderwear. When paying, your bank checks your identity thanks to an authentication code before approving the transaction.
Your bank provides this code. Please contact your bank in order to know its own authentication procedure (most of the time, it consists in a unique code sent by SMS).
The gift card can be loaded from 20 to 200 euros, in increments of 10 euros. The Gift card can be used to pay all your purchases on inderwear.com and in Les Dessous d'Apollon stores, with the exception of another gift card purchase. The web code given during the gift card purchase will be asked when using it on the internet. The Gift card is valid during a year after its issue, it is non-refundable, non-exhangeable. It can be used wihtin the limits of its value and completed by another means of payment. If your purchase does not reach the available amount on your card, the credit remains usable as a credit note.
You dispose of a 15 days period from the delivery date of your order to return it to INDERWEAR in order to exchange it or to be refunded. When the 15 days period expires on Saturday, Sunday, or on public holidays, it is extended to the next working day. If you have subscribed the Serenity Insurance presented above, you benefit from an extended return period equivalent to 60 days and the return is free.
In order to exchange an item and be refunded, INDERWEAR suggests you to follow the procedure below:
1. The return request has to be completed by writing a message on the order history, at the bottom of the order details, in order to create a "return authorization".
2. Please respect scrupulously the procedure transmitted by INDERWEAR with the return authorization. The return must be shipped as a recorded delivery parcel within 10 days after the reception of this procedure.
3. The products must be returned in their original packing, unworn and unwashed. Items and/or original packing that are returned incomplete, damaged, or dirty will not be refunded or exchanged.
In order to exchange your products, you have to wait for the return reception confirmation from INDERWEAR. You will be charged only for the difference between the amount of your exchange order and your first order.
In order to be refunded, the reception of your return has to be confirmed by INDERWEAR. The refund request has to be completed by writing message on the order history, at the bottom of the order details.
The refund will be done on the bank account or Paypal account that has been used for the initial payment of your order within 30 das after sending the confirmation of the reception of the return.
You benefit from legal warranties, especially the conformity warranty in the conditions provided from the article L211-4 to L211-14 of the French Consumer Code, and the sold product defects warranty in the conditions provided fron the article 1641 to 1648 of the French Civil Code. »
Article L211-4 of the French Consumer Code:
« The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery. He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefor or had it carried out under his responsibility. »
Article L211-5 of the French Consumer Code:
« To conform to the contract, the product must: 1° Be suitable for the purpose usually associated with such a product and, if applicable: - correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model; - have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labeling; 2° Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to. »
Article L211-12 of the French Consumer Code:
« Action resulting from lack of conformity lapses two years after delivery of the product. »
Article 1641 of the French Civil Code:
« A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them. »
Article 1648 paragraph 1 of the French Civil Code :
« The action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice. »
As part of the use of the website and its services, your personal or browsing data can be collected whether it be directly from you, or indirectly (such as the URL links from which you can reach the website, your Internet service provider, your Internet protocol address (IP)). Besides, your collected personal data are also necessary to INDERWEAR in order to open your account, to manage your order and its tracking, and if necessary, to send you commercial offers via email after receiving an express agreement from you.
As part of internet browsing, cookies can be installed on your computer. A cookie is a small file that does not identify the user, but that records information regarding the browsing of a computer on a website. Then, the collected data are used to facilitate the later browsing on the website and allow the measurement of the rate of frequentation.
A cookie installation refusal can lead to the inability to access to some website services. The user is invited to contact the publisher of his Internet browser in order to know how to disable cookies.
You dispose of an access, modification and correction right of your collected data on this website, according to the conditions predicted by the law n°78-17 of January 6th, 1978 related to computer science, files and liberties. INDERWEAR provides information (photos, texts, content) as accurate as possible on the Website and checks the veracity of all the presented elements coming from our partners. However, INDERWEAR can not guarantee the lack of inaccuracies or of differences that would result especially from the Internet nature, from your computer setup or from the fact that third partners can provide it those information.
You are invited to contact directly INDERWEAR for any further request and confirmation. We kindly remind you that you have a withdrawal right which is described in the « Exchanges and Returns » article.

The Terms and Conditions are subjected to the French law. Any litigation has to be declared to our customer service: service@inderwear.com. For the litigation settlement that can result from the interpretation, the application, the execution or the non-execution, the cessation of the Terms and Conditions, only the French Court is competent.
